5. Data Collection for Pre-Contractual Measures and Contract Performance

In the pre-contractual area, during registration, when using the supplier area and when submitting and processing requests, we process personal data that is necessary to provide the platform, facilitate contact, qualify leads, forward requests to suppliers, perform billing and manage supplier profiles.

In the pre-contractual area and when concluding a contract, we collect personal data about you. As part of pre-contractual measures, where no contract with customers has yet been concluded, the following data is collected during registration at https://labfinder.ch/de/user-registration/:

Suppliers who wish to be displayed on LabFinder may provide, or have LabFinder maintain, in particular the following data:

Contact and company data such as address, telephone and fax number, email address, website/webshop, company logo, supplier description, preferred language, product and brand portfolio and information about highlight products or visibility options.

b) Purpose and Legal Basis of Data Processing

We process this data to provide the platform, manage user and supplier functions, display supplier profiles, products and brands, receive and qualify requests, prevent spam, forward requests not classified as spam to suppliers, document the delivery and processing of leads and bill paid services.

Registration is necessary to provide the platform and supplier services.

The data collected as part of a request is necessary so that LabFinder can process and qualify the request and forward it to the selected or affected suppliers. The respective supplier can then contact the requesting user directly and handle the matter.

Without the information of the company that wishes to present itself on LabFinder, the supplier cannot use these services.

Depending on the process, the legal bases are the implementation of pre-contractual measures or a contract (Article 6(1)(b) GDPR), your consent (Article 6(1)(a) GDPR), legal obligations (Article 6(1)(c) GDPR) and the legitimate interests of LabFinder and suppliers in a functional, secure and high-quality intermediary platform, spam prevention, lead processing and billing (Article 6(1)(f) GDPR). Where Swiss data protection law applies, processing is carried out on the corresponding bases under the FADP.

c) Storage Period

Request and lead data is stored for as long as necessary to process the request, document forwarding, support suppliers, perform billing, prevent misuse and spam and comply with statutory retention obligations. Invoice and accounting data may be stored in accordance with commercial and tax retention periods. Data that is no longer required is deleted or anonymised unless legal obligations or legitimate interests prevent this.

In addition, statutory retention obligations may exist, for example commercial or tax retention obligations. Where such retention obligations exist, we block or delete your data once these retention obligations end.

7. Data disclosure

We disclose your personal data to third parties only if:

a) you have given your explicit consent pursuant to Article 6(1)(a) GDPR.

b) this is legally permissible and necessary under Article 6(1)(b) GDPR to fulfil a contractual relationship with you or to carry out pre-contractual measures.

c) there is a legal obligation to disclose the data under Article 6(1)(c) GDPR.

d) we are legally obliged to transmit data to public authorities, such as tax authorities, social security institutions, health insurers, supervisory authorities and law enforcement authorities.

e) disclosure is necessary under Article 6(1)(f) GDPR to safeguard legitimate business interests and to assert, exercise or defend legal claims, and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data.

f) we use external service providers, so-called processors, in accordance with Article 28 GDPR, who have been obliged to handle your data carefully.

We may use service providers in the following areas: IT, hosting, maintenance, email delivery, telecommunications, analytics, consent management, security, invoicing, payment processing, accounting and support.

Where personal data is transferred to third countries, this is done only on the basis of an adequacy decision, appropriate safeguards such as standard contractual clauses, or another legally permitted basis. For US providers, this may also be based on the EU-US Data Privacy Framework or corresponding certifications, where applicable.

Lead email tracking: For delivery control, quality assurance, traceability of lead processing and billing, LabFinder may process technical information on whether a lead email sent to a supplier was opened or whether links contained in it were clicked. This data is not used to secretly profile users, but serves to control and document platform performance for suppliers.

This website uses fonts from Google (Google Web Fonts). This is a service provided by Google. These web fonts are integrated through a server request, usually to a Google server in the USA.
